EXECUTIVE SUMMARY
1.0 BACKGROUND
In 2003, Ghana signed onto the Extractive Industries Transparency Initiative (EITI). By this singular action Ghana joined the list of countries implementing EITI globally. As an EITI implementing country, Ghana is required to apply the principles of the initiative to its extractive sector(s).
Introduction: The Ghana Extractive Industries Transparency Initiative (GHEITI) National Steering Committee through GTZ and the Integrated Social Development Centre (ISODEC) on behalf of Civil Society Organizations (CSOs) separately engaged the services of legal experts in 2008 to review existing legislation and recommend if Ghana required a separate legislation for her EITI process. However, the recommendations from the Consultants were different and therefore the need to undertake a stakeholder consultation in arriving at a final decision on whether or not Ghana requires a separate legislation for her EITI process.
In its ongoing effort to fight corruption and increase energy security, the U.S. Helsinki Commission has worked in recent years to help countries fight the resource curse. That is the phenomenon in which countries that are rich in oil, gas or minerals—resources that should be a boon to their economy—suffer lower economic growth and higher poverty than countries without extractive resources.
Stakeholders at a roundtable meeting to deliberate on whether or not there is the need for Ghana to legislate the Extractive Industries Transparency Initiative have agreed that legislation is a must for the purpose of sustaining the initiative, and giving true expression to government's commitment to transparency and accountability in natural resource governance.

AIDED by the performance of the Minerals Commission over the last two decades, the mining sector has played a key role in the development of Ghana's economy, with production increasing significantly, export earnings growing from 20 per cent to 45 percent of total export and Gross Domestic Product (GDP) improving from 1.5 per cent to six per cent.

1. Introduction
There are several reasons why Ghana constitutes an important case to be considered in any account of the Extractive Industry Transparency Initiative (EITI) and mining. For one, Ghana was one of the first countries to adopt the voluntary initiative in 2003 and, in fact, constitutes the first candidate country to deal with the mining sector only.
The basic concept of EITI is for the extractive industries making payments, Government receiving revenues and for Civil Society playing a watchdog role to ensure sanity in revenue - flow streams...
